1. Definitions

a. "North Shore Handyman" refers to Nikolai Komarov, a sole trader operating in New Zealand. 
b. "Client" refers to the person or entity contracting the North Shore Handyman for services. 
c. "Services" refers to the handyman, repair, maintenance, and related services provided by the North Shore Handyman.

2. Scope of Services

a. The North Shore Handyman agrees to provide the Services as described in the quotation, work agreement or invoice. 
b. The Client agrees to provide access to the property, electricity, water, and any other necessary resources for the Handyman to complete the Services.

3. Pricing and Payment

a. The Client shall pay the North Shore Handyman the agreed-upon fee for the Services, as specified in the quotation, work agreement or invoice. 
b. Payment shall be made according to the terms outlined in the quotation, work agreement or invoice, including any required deposit.
c. The Client shall incur penalty interest at a rate of 1.5% per month, calculated on a daily basis, on any outstanding amounts invoiced by North Shore Handyman that remain unpaid after the 20th day following the due date for payment;
d. The Client shall pay the actual legal costs and/or expenses (whatsoever and howsoever) incurred by North Shore Handyman in enforcing these terms and conditions and the collection of any unpaid sums invoiced by North Shore Handyman;
e. All payments must be made in New Zealand dollars (NZD).

4. Cancellation

a. Either party may cancel the Services by providing written notice. 
b. The Client may be responsible for any costs incurred up to the date of cancellation as outlined in the quotation, work agreement or invoice.

5. Materials and Supplies

a. The North Shore Handyman will provide materials and supplies, unless otherwise specified in the quotation, work agreement or invoice. 
b. The Client may be responsible for the cost of materials and supplies, as outlined in the quotation, work agreement or invoice.

6. Warranty

a. The North Shore Handyman warrants that the Services will be performed in a professional and workmanlike manner. 
b. The North Shore Handyman may offer a warranty on labour, which will be specified in the quotation, work agreement or invoice.

7. Liability

a. The North Shore Handyman shall not be liable for any damage to property, injury, or loss that may occur during the provision of Services, except in cases of gross negligence. 
b. The Client is responsible for ensuring their property is adequately insured.

8. Insurance

a. The North Shore Handyman holds the necessary insurance coverage as required by New Zealand law.

9. Consumer Guarantees Act

a. In accordance with the Consumer Guarantees Act 1993, nothing in these Terms and Conditions is intended to limit or exclude any statutory rights or guarantees the Client may have as a consumer.

10. Dispute Resolution

a. Any disputes shall be resolved through negotiation or mediation before pursuing legal action.

11. Governing Law

a. These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand.

12. Changes to Terms and Conditions

a. The North Shore Handyman reserves the right to amend these Terms and Conditions, and any changes will be communicated to the Client in writing or email.

13. Entire Agreement

a. These Terms and Conditions constitute the entire agreement between the North Shore Handyman and the Client and supersede all prior agreements or understandings.

By accepting the Services from the North Shore Handyman, the Client acknowledges and agrees to these Terms and Conditions. It is recommended that the Client carefully read and understand these Terms and Conditions before entering into an agreement with the North Shore Handyman.
